Terms & Conditions — Hawknest Roadside

By accessing this website or using Hawknest Roadside, you agree to the following Terms & Conditions. If you do not agree, please do not use our services or website.

Services Provided

Hawknest Roadside provides roadside assistance services including, but not limited to:

  • Jump starts
  • Lockouts
  • Tire services
  • Fuel delivery
  • Battery services
  • Light mechanical services (when applicable)
  • EV roadside support
  • Winch out services

Service availability may vary by location, weather, traffic, and technician availability.

No Guarantee of Results

While we strive to resolve roadside issues efficiently, we do not guarantee that all vehicle problems can be fixed roadside. Some situations may require towing or additional services.

User Responsibilities

By requesting service, you agree to:

  • Provide accurate location and vehicle information
  • Ensure the vehicle is accessible and safe to service
  • Follow technician instructions during service

Hawknest Roadside is not responsible for delays or service issues caused by inaccurate information or unsafe conditions.

Pricing and Payment

  • Pricing is based on service type, location, time, and complexity
  • Prices will be communicated prior to or at the time of service when possible
  • Payment is due at the time of service unless otherwise agreed
  • Additional charges may apply for after-hours, specialty vehicles, or complex service conditions

Limitation of Liability

To the fullest extent permitted by law:

  • Hawknest Roadside is not liable for indirect, incidental, or consequential damages
  • Our liability is limited to the amount paid for the service rendered
  • We are not responsible for pre-existing vehicle conditions, mechanical failures, or damage unrelated to our service

Indemnification

You agree to indemnify and hold harmless Hawknest Roadside from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

Service Cancellations and No-Shows

If you request service and cancel after a technician has been dispatched, cancellation fees may apply. These fees help offset the cost of dispatching a technician to your location. The amount of any cancellation fee will depend on how far the technician has traveled and how much time has elapsed since dispatch.

If you are not present at the service location when our technician arrives, or if you do not respond to contact attempts, this may be considered a no-show. No-show fees may apply in these situations. We make every effort to contact you before leaving the location, but repeated contact attempts without response may result in service cancellation and applicable fees.

Vehicle Safety and Accessibility

For your safety and the safety of our technicians, we reserve the right to refuse service in situations where:

  • The vehicle is located in an unsafe or inaccessible location
  • Weather or road conditions make service unsafe
  • The customer is intoxicated, hostile, or otherwise creating an unsafe environment
  • The vehicle presents hazards not disclosed when service was requested

If service is refused for safety reasons, you will be notified and assisted with alternative solutions when possible.

Towing and Vehicle Transport

When we provide towing services, we take reasonable care to protect your vehicle during loading, transport, and unloading. However, you acknowledge that:

  • Pre-existing damage to your vehicle may become more visible or problematic during transport
  • Very low-clearance vehicles, modified vehicles, or vehicles with non-standard equipment may be more susceptible to minor contact during loading
  • We will document the condition of your vehicle before towing when possible
  • Claims for damage must be reported immediately upon delivery, with supporting documentation

Insurance and Claims

We maintain appropriate business insurance for our operations. If you believe our service caused damage to your vehicle, you must:

  • Report the concern immediately to the technician on scene before they leave
  • Provide photographic documentation of the claimed damage
  • Submit a written claim to our company within 48 hours
  • Cooperate with any investigation or insurance claim process

Claims submitted after significant delays or without proper documentation may not be processed.

Third-Party Service Providers

In some situations, we may coordinate service through partner or contracted service providers. While we vet our partners carefully, we do not control their actions and our liability for third-party provider performance may be limited. When we arrange service through a third party, we will inform you of this arrangement.

Warranty Disclaimer

Our roadside assistance services are provided "as is" without warranties of any kind, either express or implied. We do not warrant that:

  • Service will be available in all locations at all times
  • Response times will meet any specific timeframe
  • All vehicle problems can be resolved roadside
  • Service will meet your particular requirements

To the extent permitted by law, we disclaim all warranties including implied warranties of merchantability and fitness for a particular purpose.

Dispute Resolution

If you have a dispute with Hawknest Roadside regarding services provided, pricing, or any other matter, we encourage you to contact us directly first. Most disputes can be resolved through direct communication. If a dispute cannot be resolved informally, you agree that any legal action must be brought in the appropriate courts of Sonoma County, California.

Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely matches the intent of the original provision.

Website Use

You agree not to:

  • Use the website for unlawful purposes
  • Attempt to interfere with site security or functionality
  • Submit false or misleading information
